Terms Of Use

  1. Scope 

    • Any use of “Managed AI-API Hub” provided by Siemens Healthineers AG ("Siemens Healthineers"), is subject to these Terms of Use. These Terms of Use may be amended, modified or replaced by other terms and conditions at any time. With log-in, or where a log-in is not required, in accessing or using Managed AI-API Hub, these Terms of Use are accepted in their then current version.  

  2. Services 

    • Description 

      • The Managed AI-API Hub is a centralized platform that provides Siemens Healthineers developers with access to a suite of AI model & service APIs, enabling the integration of advanced AI services & models, such as GPT-4-turbo, GPT-4, and embeddings, etc. into their applications. 

      • Subject to the limitations outlined in Section 3, users will have the opportunity to:  

      • Engage with AI services and Large Language Models through the use of an API. 

      • The platform's primary objective is to furnish Siemens Healthineers developers with API access to AI services and Large Language Models within a secure, managed environment. It is hosted on an isolated Azure cloud infrastructure provided by Microsoft. It is important to note that neither uploaded data nor chat interactions will be utilized for training Large Language Models, nor will they be assessed by third parties, including Microsoft or OpenAI. 

    • Siemens Healthineers may stop the operation of Managed AI-API Hub in full or in part at any time. Due to the nature of the internet and computer systems, Siemens Healthineers does not provide any service levels and excludes any liability for the accessibility, disaster recovery or availability of Managed AI-API Hub.   

  3. Restriction/ Duties of the User 

    • Please use Managed AI-API Hub only for internal, not business critical purposes. Information or data provided in Managed AI-API Hub might be wrong or could infringe the rights of third parties (e.g. copyright)! 

    • Therefore, please observe the following usage restrictions: 

      • Use Managed AI-API Hub only for uncritical, internal activities. 

      • Don’t use Managed AI-API Hub for product or software development. 

      • Upload only uncritical data which is at the maximum classified as “confidential” (“C2” according to SHS’ asset protection evaluation metric)  

      • Be aware that your input/ uploads might be seen by other users within Siemens Healthineers. Please upload or share only such data or information which you want others to see.  

      • Don’t upload any confidential contracts, product data, software, technology or business secrets. 

      • Don’t upload personal data unless you have an approved HDPR (“Healthineers Data Privacy Register”) entry. 

      • Don’t use the provided information for (critical) business decisions. 

      • Don’t share or use the AI created information or data with externals (e.g. customers). The data might be wrong, infringe third party rights or could contain SHS’ business secrets. 

      • The AI generated results must be verified, carefully interpreted and incorporated into a decision-making-process. 

      • Mark every AI- generated content/document transparently as “created by AI algorithm”, followed by the identifier and version number of the used AI. This shall allow others to critically verify the content of such contents later. 

      • Do not publicly disclose or discuss any input or output information fed into or generated by a chatbot to the extent such information relates to Siemens Healthineers business, personnel, products and services.  

      • Upload only such data whose disclosure would not lead to any harm for Siemens Healthineers (legal risks, reputation, business secrets).  

  4. In accessing or using HealthineersGPT, You shall not 

    • Upload any personal data/ personally identifiable information (PII) unless you have an approved HDPR (“Healthineers Data Privacy Register”) entry  

    • Upload any PHI data, DICOM images or pictures of people who can be recognized unless the affected persons have consented, 

    • upload data which is classified as “strictly confidential” (classification level C3), 

    • upload any information or data which can be subject to Embargoes or Export Control restrictions (e.g. source code or technology), 

    • upload any (source or object) code or technology. 

    • Insult or harm other persons, in particular minors, or infringe their personal rights, 

    • breach public morality in its manner of use, 

    • violate any intellectual property rights or any other proprietary rights (especially copyright); 

    • use the service for any illegal or unethical activities, 

    • upload any contents containing a virus, so-called Trojan Horse, or any other program that could damage data, 

    • transmit, store or upload hyperlinks or contents to which You are not entitled, in particular in cases where such hyperlinks or contents are in breach of confidentiality obligations or unlawful; or 

    • distribute advertising or unsolicited e-mails (so-called "spam") or inaccurate warnings of viruses, defects or similar material and the User shall not solicit or request the participation in any lottery, snowball system, chain letter, pyramid game or similar activity. 

  5. Siemens Healthineers may deny access to Managed AI-API Hub at any time, in particular if the User breaches any obligation arising from these Terms of Use. 

  6. Siemens Healthineers may delete uploaded data to Managed AI-API Hub at any time, in particular if the User breaches any obligation arising from these Terms of Use. 

  7. If you notice any non-conformance with these Terms of Use, please contact the 

  8. API Request 

    • If you request access to the Managed AI-API Hub API for a specific use case, please make sure you have  

      • completed the CAP assessment, 

      • an approved HDPR (“Healthineers Data Privacy Register”) entry if you upload personal data, 

      • informed the worker council. 

  9. Right to use Input 

    • Siemens Healthineers may, without charge, use any ideas or proposals stored or uploaded by a User on Managed AI-API Hub for the development, improvement and sale of its products or other commercial purposes.  

  10. Hyperlinks 

    • Managed AI-API Hub may provide hyperlinks to web pages of third parties. Users shall critically assess whether such third party web pages are secure before they access the web page. Siemens Healthineers shall have no liability for the contents of such web pages and does not make representations about or endorse such web pages or their contents as its own, as Siemens Healthineers does not control the information on such web pages and is not responsible for the contents and information given thereon.  

  11. Liability 

    • To the extent legally permissible, any liability of Siemens Healthineers is excluded except for cases involving willful misconduct, gross negligence, personal injury or death. 

    • The output of Managed AI-API Hub may contain information or general descriptions which might not be correct in every case. Please check thoroughly if the provided information is really correct before applying it. 

    • Although Siemens Healthineers makes every endeavor to keep Managed AI-API Hub free from viruses, Siemens Healthineers cannot make any guarantee that it is virus-free. The User shall, for its own protection, take the necessary steps to ensure appropriate security measures and shall utilize a virus scanner before downloading any information, software or documentation. 

  12. Compliance with Export Control Regulations 

    • Please be aware that Managed AI-API Hub basically also allows the up- and download of information, data, software or documentation which might be subject to Export Control Regulations or embargoes. 

    • Please don’t upload any software (source and object code) or technology on Managed AI-API Hub. Please don’t upload any data or information which can be subject to subject to Export Control Regulations or embargoes. 

    • If the User is uploading or transfers information, data or documentation, the User shall comply with all applicable national and international (re-) export control regulations. In any event of such transfer the User shall comply with the (re-) export control regulations of the Federal Republic of Germany, of the European Union and of the United States of America. 

    • Prior to any such upload or transfer to a third party the User shall in particular check and guarantee by appropriate measures that 

      • there will be no infringement of an embargo imposed by the European Union, by the United States of America and/ or by the United Nations by such transfer or by provision of other economic resources in connection with information, software and documentation provided by Siemens Healthineers, also considering the limitations of domestic business and prohibitions of by-passing those embargos; 

      • such information, software and documentation provided by Siemens Healthineers are not intended for use in connection with armaments, nuclear technology or weapons, if and to the extent such use is subject to prohibition or authorization, unless required authorization is provided; 

      • the regulations of all applicable Sanctioned Party Lists of the European Union and the United States of America concerning the trading with entities, persons and organizations listed therein are considered. 

      •  If required to enable authorities or Siemens Healthineers to conduct export control checks, the User, upon request by Siemens Healthineers, shall promptly provide Siemens Healthineers with all information pertaining to the particular end-user, the particular destination and the particular intended use of information, software and documentation, as well as any export control restrictions existing.  

  13. Data Privacy Protection 

    • For collection, use and processing of personally identifiable data of the User of Managed AI-API Hub, Siemens Healthineers shall comply with applicable laws on data privacy protection and the Siemens Web Site Data Protection Privacy Policy, which is available per hyperlink on the Siemens Healthineers Intranet.  

  14. Applicable Law, Place of Jurisdiction 

    • These Terms of Use shall be governed by - and all disputes relating to or in connection with these Terms of Use or their subject matter shall be resolved in accordance with - the laws of Germany, to the exclusion of its conflict of laws rules. The application of the United Nations Convention on Contracts for the International Sales of Goods (CISG) of 11 April 1980 is excluded. 

    • The place of jurisdiction shall be Munich, Germany.
